SAMPLE HOLIDAY LIGHTING AGREEMENT This Sample Holiday Lighting Agreement (“Agreement”) is entered into between (Your Business Name) and __________________________ (“Customer”). Payment Terms A non-refundable deposit of 50% of the total project cost is required at the time of scheduling to secure installation dates. The remaining 50% balance is due upon completion of installation. Failure to remit payment upon completion may result in removal of installed materials and/or additional fees. A finance charge of 1.5% per month (18% annually) will be applied to all outstanding balances. Materials & Ownership All lighting materials, equipment, and accessories provided by (Your Business Name) remain the property of the company unless otherwise stated in writing. Installation & Removal Installation and removal dates are scheduled based on availability and weather conditions. While every effort will be made to meet scheduled dates, (Your Business Name) is not responsible for delays caused by weather, access limitations, or unforeseen circumstances. Liability & Damage (Your Business Name) is not responsible for damage or loss caused by vandalism, theft, extreme weather conditions, or acts of God. Replacement or repair of damaged materials may be performed at an additional cost. Warranty & Service No warranty or complimentary service is expressed or implied unless explicitly stated in writing. While (Your Business Name) strives for full functionality, the company does not guarantee that every individual bulb will remain illuminated for the entire installation period. Any replacement of malfunctioning product will be handled according to the terms specifically outlined in writing, if applicable. Electrical & Site Conditions All proposals are made under the assumption that safe and adequate access to installation areas is available, that mounting surfaces are suitable for installation, and that functional electrical outlets are available near installation locations. Customer is responsible for maintaining and providing adequate electrical outlets adjacent to the proposed locations for lit decorations and building lights. Cancellations & Rescheduling By signing this Agreement, Customer acknowledges that (Your Business Name) schedules projects well in advance. Any cancellation after scheduling will result in a charge of 50% of the labor cost. Requests to reschedule installation dates may be subject to availability and additional fees. Indemnification Customer agrees to indemnify and hold harmless (Your Business Name) from any claims, damages, losses, or liabilities arising from the installation, use, or removal of lighting and decorations, except in cases of gross negligence or willful misconduct. Governing Law & Dispute Resolution This Agreement shall be governed by the laws of the State of (Your State). If a dispute arises out of this Agreement, the parties agree to resolve the dispute through binding arbitration in (Your County) before a single arbitrator. Any judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The prevailing party in arbitration shall be entitled to its reasonable attorney’s fees and costs. Entire Agreement This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, proposals, or understandings. Authorization By signing below, Customer agrees to the terms of this Agreement and accepts this proposal on those terms. Customer further declares that he or she is authorized to sign this document, either as an owner of the property or as an agent for the owner or entity.
